Misdemeanors carry punishments of less than one year in prison and serious fines depending on the "class" and type of crime.

Felonies carry potential sentences or more than one year in prison and up to life. A felony conviction carries a fine of up to $10,000 in state prosecutions, and in federal prosecutions, possible into the millions. The worst part of a felony is the jail sentencing.

Drug charges vary based on the type and amount of the drug. Usually, the prosecution considers whether the person charged made, delivered, or possessed the drug; and whether the drug offense was committed in a drug-free zone.

State Felonies include:

  • First-degree is the most serious and includes life in prison, $10,000 fine
  • Second-degree is two to 20 years, $10,000 fine
  • Third-degree is two to 10 years, $10,000 including DWI (third conviction)
  • State jail – 180 days to 2 years, $10,000 fine

State Misdemeanors include:

  • Class A: Up to one year and $4,000 fine
  • Class B: Up to 180 days and $2,000 fine
  • Class C: Fine up to $500 but no jail
