First Offense: Class B Misdemeanor • up to 6 months in county jail. • Open alcohol minimum jail stay is 6 days • Max $2,000 fine
Second Offense: Class A Misdemeanor • up to 1 year county jail • Max $4,000 fine
Third Offense: Third-Degree Felony • up to 10 years in jail Max $10,000 fine
DWI or DUI — What's the Difference?
Each state has its own laws regarding DWIs and DUIs. In Texas, drunk driving charges are DWIs (Driving While Intoxicated). The term DUI (Driving Under the Influence) refers only to individuals under 21 years of age who have had some alcohol but remain under the .08 blood-alcohol level (BAL).
DWI "Collateral" Consequences
At the time of your arrest, when the officer takes your license, he also gives you a notice of suspension/temporary driving permit. You must request a hearing within 15 days or you automatically lose your license for a minimum of 90 days for failure of the BAC. If you did not take the breath test, you lose your license for 180 days.
DWI surcharges, which must be paid to keep your license, range from $1,000 a year for three years on up to $2,000 a year.
Other Collateral Consequences Include:
